The Directive is a recast of Directive 96/96/EC with changes in the administrative articles; the content of the annexes has not changed. The principal changes can be found under Article 6.
It has the following impact on the procedures for modifying the Directive:

Changes to Annex I on vehicles categories subject to testing and testing frequencies will need European Parliament approval. (Formerly European Commission)

Changes to Annex II can be approved at European Commission level. (This was already the case)

The European Commission will also be responsible for adopting standards and methods for testing the items listed in Annex II. (This is a new requirement)
Directive 2009/40/EC is also available on the secure part of the CITA website under Members Only > All members > Library > Legislation > EC together with other Directives on roadworthiness tests of motor vehicles and their trailers.
